This week, candidates receive the official EQE results, confirming the results published last week. Included is a marking sheet, showing the number of points per question.
Candidates who unfortunately need to resit C and/or D will be trying to figure out how to do it differently in 2012. The marking sheets and the Examiner's Reports in the Compendium are generally not enough to figure out where points were lost.

EQE 2011 results (2): excluding 0 points
The figures change a little if you leave out the candidates who got 0.
As it is very unlikely to make a paper and get 0 points, we assume most of these were registered but did not turn up.
Average nr. if points if all 0 scores are excluded:
D = 41 (2010: 46)
C = 44 (2010: 45)
B (e/m & ch) = 55.5 (2010: 51.5)
A (e/m & ch) = 50.5 (2010: 47.5)

A complete list is available here. It look like D was more dificult than last year, and B was overall easier
Congratulations to all who passed at least something- none of the exams are easy, so if you passed anything you did well. Remember: 45 points and up means you can compensate with other passes, even old ones.

RFees references - incorrect
In April last year, the Rules relating to Fees (RFees) Art.2 was updated – it now has a (1) paragraph for current fees and a (2) paragraph for fees that apply to applications filed before 1 April 2009.

Although I do not expect the examination committee to be to critical on this, it is incorrect in all our materials.
For current fees, if you want the completely correct reference, you should also give the paragraph number (1)
So for example, the fee for further processing was RFees 2.12, and it is now RFees 2(1).12
The fee index number (.1 .1a .2 .3 etc) have not changed.

Our printable versions of the PCT Applicants Guide - available now for EQE2011
The Examination Board will make a printable version available in the next couple of weeks. The Dec. 2010 version will appear here on the right-hand side of the page when it is ready)
However, this document is 1700 pages with a lot of information that will never be asked on the EQE, such as details on African states. Also there are other things on the WIPO web-site which you should have with you that are not included in the 1700 pages.
As an alternative, I have captured and assembled 3 books. They are intended to be printed with 2 pages on each A4 sheet and double-sided. The specific information on states is restricted to EPC states, the largest patent offices, the 12 most popular rO's, and the 12 most popular dO's & eO's.

- All these rO's allow filings by their residents and nationals.
- All allow the EPO to be used as ISA, except for KP, PG & ZM
- If the EPO was the ISA, then all these rO's also allow the EPO to be the IPEA
- No information at all is available for these rO's: AG, DM, GD, KM, KN, VC

The 2010 version of the Ancillary Regulations is now available here
This book replaces the Special Edition 3 from 2007 and the old EPC1973Ancillary Regulations book.

G1/09 - do you need to know it for the exam?
The short answer is: yes.
The syllabus states that you need to know the law as of 31/12/2010 and EQE 2011 will certainly have a number of questions on divisionals.
Your answer to a simple question like: "you anticipate a refusal in oral proceedings next week - what is the last possible moment to file a divisional?" may now be completely different. (see here for the answer)
I would also say that this is essential knowledge for daily life.
Also the legal basis for being able to file up to (but not including) the mention of the grant is no longer OJ 2002, 112 or GL A-IV, 1.1.1. It has now become Art.67(4), G1/09.

Serbia = newest EPC state
Always important on the EQE are the EPC member states. For any filings on or after 1 Oct 2010, Serbia will be designated. For filings < 1 Oct 2010, Serbia can only be approached via the extension system from an EP filing. More details here

Get tips from past EQE candidates

There is no "golden" route that works for everybody - you have to find your own way, but the most important points are:

- Make a plan
- Don't start preparation too late - depends on your work, family & social commitments
- Reading is not enough - practice applying the law (doing questions, past papers)
- Don't underestimate C and DII
- Practice writing by hand
- Get feedback from tutors / colleagues etc on your answers to papers

From 1/7/2010, the EPO will offer Supplementary International Searches. This will almost certainly be in the D paper.

New: Distance Learning for legal part of paper D
Our distance learning package for the paper D legal part is now available here for EQE 2011.
This unique course concept allows you to study the EPC/PCT whenever and wherever you want, but with the security and guidance of individual feedback, and a steady study and homework schedule to get you through the material. We already have a couple of people doing this, so I defined a package for it.
This legal training is the perfect preparation before participating in our Correction Papers program, which can also be done at distance.

Final version Guidelines AND potential EQE 2011 Exam topics
The provisional version of the Guidelines from December has now been finalized.
It is available here.
This should be the version that you will use for EQE 2011 – it is unlikely they will update it again this year.
The notice below gives the changes compared to the last finalized version of April 2009.
We have not yet identified any changes since the provisional version of December.
However, as the exam committee likes to ask questions on things that have changed, you can consider this list as an overview of potential exam topics.

Draft 2010 version of EPO Examination Guidelines now available
Today (30/11/09), the EPO published a draft version of the Examination Guidelines. These Guidelines are updated based upon the EPC changes scheduled for 1/4/10, and may possibly be updated again.

The Chairman of the Examination Board has also posted a notice, stating very clearly, that the version to be used on the EQE2010 is the version of 1 April 2009.
